Personal Data Protection Policy

The Personal Data Protection Policy contains detailed information on the processing of personal data whilst visiting the mzdovaakademia.sk website and participating in the educational activities organised by MAXIM s.r.o., on the rights of individuals whose personal data are processed and on the corresponding responsibilities and procedures of MAXIM s.r.o. as the website's operator.
The processing and protection of such personal data is governed by the provisions of Act No. 18/2018 Coll. on Personal Data Protection, as amended (hereinafter referred to as the “Act”), in conjunction with the provisions of Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (hereinafter referred to as the “GDPR regulation”).

Definitions

Personal Data Protection Policy defines the general terms and policy of personal data protection applicable by MAXIM s.r.o., a.s., Dúbravská cesta 2, 841 04 Bratislava, Company ID No.: 47 529 474, registered in the Commercial Register of the District Court Bratislava I, Section: Sro, Insert No.: 94358/B in the processing of personal data of visitors to the www.mzdovaakademia.sk website (hereinafter referred to as the “website”) and in the processing of personal data of participants of trainings and courses (hereinafter referred to as the “educational activities”) organised by MAXIM s.r.o.

The term Controller refers to the person processing the personal data of the data subject (you). The Controller is MAXIM s.r.o., Dúbravská cesta 2, 841 04 Bratislava, Company ID No.: 47 529 474, registered in the Commercial Register of the District Court Bratislava I, Section: Sro, Insert No.: 94358/B (hereinafter referred to as the “Controller”). The term Data subject refers to any natural person who has registered for educational activities or provided their personal data to the Controller by other means (e.g. in order to receive a payroll newsletter). These are primarily natural persons who utilise the educational services of the Controller.

The term Personal data refers to any data from which the data subject can be identified or identifiable. The extent of your personal data processed by the Controller depends on the purpose for which the personal data are processed.

The term GDPR regulation refers to Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) applicable to the processing of personal data within the EU, including the Slovak Republic.

The Personal Data Protection Act refers to Act No. 18/2018 Coll. on Personal data protection, and on amendments to certain acts, as amended, which govern, in addition to the GDPR, the processing of personal data in the Slovak Republic. The Controller processes personal data in the manner specified in and within the limits of the Personal Data Protection Act and the GDPR in order not to violate the fundamental rights and freedoms of users, in particular not to violate their right to human dignity nor cause other unauthorised interference with their right to privacy.

Personal Data Processing when Submitting the Registration Form

The personal data of the data subject processed by the Controller for the purpose of registration for an educational activity and for the purpose of issuing a tax document are as follows: name and surname, address, Company ID No., Tax ID No., VAT ID No., telephone number and email address of the data subject.

Such personal data are collected by the Controller upon the data subject’s registration by completing the registration form on the website or in printed form or in the form of a filled-out online form sent via email to info@mzdovaakademia.sk and are processed for the purpose of registering the data subject for an educational activity organised by the Controller and for the purpose of sending the data subject notices related to the educational activity.

The legal basis for the processing of such voluntarily provided data is the consent of the data subject pursuant to Section 13(1)(c) of the Act in conjunction with the provisions of Article 6(1)(c) of the Regulation provided by the data subject via the registration form for an educational activity or by sending an email to the Controller’s e-mail address at info@mzdovaakademia.sk, where the personal data processing is necessary under a special regulation (e.g. the Accounting Act) or under an international convention to which the Slovak Republic is a party.

Personal data shall be processed for the duration of the legal obligations arising from the generally binding legal regulations, in particular the Civil Code, the Act on Counteracting the Legalisation of Proceeds from Crime, the Accounting Act, the Act on Archives and Registries, and the Act on Value Added Tax, i.e. for a period of at least 10 years for some data on tax documents.

The processing of the personal data of the data subject may be entrusted to the provider of services and shall consist of ensuring proper operation of these websites, where the provider may encounter personal data, or to the provider of the accounting services when entering the tax documents of the data subject into the Controller’s accounts or to the provider of delivery services (hereinafter individually referred to as the “Intermediary”). No automated decision-making or profiling shall take place when processing the personal data of the data subject, and it shall not be the intention of the Controller to provide the personal data to a third country, an international organisation or a third party.

Personal Data Processing when Subscribing to a Newsletter

The personal data of the data subject processed by the Controller for the purpose of sending information on legislative news in payroll accounting and on the offer of educational activities (payroll newsletter) are as follows: email address of the data subject.

The legal basis for the processing of such voluntarily provided data is the consent of the data subject pursuant to Section 13(1)(a) of the Act in conjunction with the provisions of Article 6(1)(a) of the Regulation provided by the data subject via the registration form for an educational activity or by sending an email to the Controller’s e-mail address at info@mzdovaakademia.sk. Such consent may be withdrawn by the data subject at any time via a registration form in the “Notes” field, or by sending an email with the subscription cancellation request to the Controller’s e-mail address at info@mzdovaakademia.sk, or upon written request sent to the Controller’s address at MAXIM s.r.o., Dúbravská cesta 2, 841 04 Bratislava.

Personal data shall be processed for the duration of the data subject’s interest in receiving the Controller’s payroll newsletter, i.e. for the duration of the purpose of their processing. No automated decision-making or profiling shall take place when processing the personal data of the data subject, and it shall not be the intention of the Controller to provide the personal data to a third country, an international organisation or a third party.

Rights of the Data Subject

The data subjects whose personal data are processed by the Controller are conferred certain rights under the Personal Data Protection Act. The data subjects’ rights consist primarily of the following rights, which the data subject may claim against the Controller:

The right to obtain information on the processing of personal data, according to which the Controller shall have a corresponding obligation to provide the person whose data are to be processed with detailed information on the personal data processing, to the extent stipulated by the Act.

The right of access to the processed personal data, according to which the data subject may ask the Controller to issue a confirmation that personal data concerning the data subject are being processed, to the extent stipulated by the Act.

The right to rectification, erasure and restriction of personal data processing, according to which the data subject may ask the Controller to rectify the processed personal data concerning the data subject, erase such personal data or restrict the processing of such personal data without undue delay, to the extent and for reasons stipulated by the Act.

The right to personal data portability, according to which the data subject may ask the Controller to transfer the processed personal data in a structured format and to transmit those data to another controller.

The right to object to the personal data processing, according to which the data subject may object to the processing of such personal data, where the personal data are processed by the Controller on the basis of a necessary legitimate interest (legal basis). The Controller shall no longer process the personal data unless the Controller demonstrates compelling legitimate grounds for the processing.

The right to object to the personal data processing, according to which the data subject may object to such processing of personal data where the personal data are processed by the Controller for the purposes of direct marketing. Should the data subject object to the processing of personal data for the purposes of direct marketing, the Controller shall no longer process the personal data of the data subject for such purposes.

The right to report the personal data protection to the Personal Data Protection Authority if the Controller and/or the Intermediary processes personal data in violation of the Regulation and/or the Act.
